This “agreement” of terms and conditions and our privacy policy creates a binding legal contract between you, Personal Harmony and Love Match Pty Ltd [ABN 33 165 535 580] a company incorporated in the State of Victoria and having its principal place of business at 2/9 Blake St, Mornington, VIC 3931 By accessing the My Personal Harmony web site, at www.MyPersonalHarmony.com (“site”), and where applicable, receiving any of its associated support services you become a user and agree to, and are bound by, the terms and conditions of this Agreement. Your use of, or participation in, certain support services may be subject to additional terms, and such terms will be either listed in this Agreement or will be presented to you for your acceptance when you sign up to use such services.

We also maintain the right to cease to offer any of its support services at any time without prior notice. This Agreement is also subject to change by us at our sole discretion at any time and without notice. Personal Harmony makes every effort to ensure that our website provides you with uninterrupted service, 24 hours a day. 2. Use of Proprietary Information. You are prohibited from in whole, or any part, posting, copying, modifying, communicating, transmitting, publishing, displaying, disclosing, showing to the public, creating any derivative works from, distributing, making commercial use of, or reproducing in any way any, the Proprietary Information or copyrighted materials, trade-marks and other proprietary content accessible via www.MyPeronalHarmony.com and it’s associated services, without first obtaining the prior written consent of the owner of the proprietary rights.

User Information

3. Disclosure By Law We may disclose information you provide to your Practitioners in the course of providing you with our services.

Limitation of Liability

1. No Liability for Site Use We make no representations or warranties as to the outcome of our services. LoveMatch will not be in any way liable for any damages, whether direct, indirect, general, special, compensatory, consequential, and/or incidental, arising out of or relating to the conduct of you or anyone else in connection with the use of our site and its support services, including without limitation, mental or emotional distress.
2. In no event shall Personal Harmony or Love Match be liable for any incidental, special, consequential or indirect damages arising out of or relating to the use or inability to use the site or services, including, without limitation, damages for loss or corruption of data or programs, service interruptions and procurement of substitute services, even if Personal Harmony and Love Match has had knowledge of the possibility of such damages. Under no circumstances will Love Match’s aggregate liability, in any form of action whatsoever in connection with this agreement or the use of our site and support services, exceed the price paid by a site user.

Indemnity

You agree to indemnify and not hold to account, Love Match, its Directors, staff, agents and third parties, against any claims, causes of action, debts, losses, costs, liabilities and expenses (including reasonable legal fees) relevant to or arising out of;

1. your use of or inability to use our site at www.MyPersonalHarmony.com and its related support services
2. any information, content or images/videos provided or posted by you,
3. your breach of any terms of this Agreement or any violation of a third party’s rights, or
4. contravention of any relevant laws, rules or regulations.

Termination and Suspension of Service.

Love Match may terminate your account at any time, for any reason, without explanation, effective upon sending written notice to the other party.

In the event your access to our site or support services is suspended or terminated due to a violation by you (determined by the discretion of LoveMatch) of the terms of this Agreement, you agree that all fees then paid to Love Match are non-refundable and all outstanding or pending payments will immediately be due and payable.

Cancellation of Service.

You are required to fulfil your payment contract if you do not notify your practitioner more than 24 hours ahead of being unable to make an appointment.

No Liability

       Love Match will not be liable for:

1. Any act or event beyond the reasonable control of Love Match, including without limitation fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster, or failure of public or private telecommunications networks.
2. any failure to perform or any delay in performance of, any of its obligations under these Terms and Conditions caused by any act or event beyond the reasonable control of Love Match.

In the event of any act or event beyond the reasonable control of Love Match that results in our service being unable to be provided for 14 days or more, either party may immediately terminate this agreement.

Provisions.

Law and Jurisdiction. This Agreement is governed by the laws of Victoria, Australia. Before resorting to any external dispute resolution mechanisms, the party(s) in dispute with Love Match agree to firstly attempt to settle any dispute arising out of or in connection with this Agreement, our site or support services, by mediation.

Miscellaneous.

1. Unless otherwise expressly stated, the provisions of this Agreement will survive cessation of your registration and access to our service(s);
2. The failure of Love Match to exercise or enforce this Agreement, does not in any way constitute a waiver of such a right;
3. If any part of this Agreement is held up to be invalid, the remainder of this Agreement will remain to continue in full force and effect;
4. To the maximum extent permitted by law, any claim or cause of action arising out of or related to the use of the Personal Harmony site, support services or this Agreement, must be filed within one (1) year after such claim or cause of action arose.
